Supreme Court to hear tomorrow Satyendar Jain’s request to transfer case to another judge

By Srishti Ojha: The Supreme Court today agreed to hear Delhi Minister Satyendar Jain’s plea tomorrow against having his money laundering case transferred to another court.

Senior Advocate Kapil Sibal, representing Jain, mentioned the case before a bench headed by India’s Chief Justice, UU Lalit.

The Delhi High Court had earlier upheld the decision to transfer the case at the request of the Directorate of Enforcement (ED).

The High Court had dismissed Jain’s challenge to the trial court’s order transferring the case from one special judge to the other at the request of the ED. She observed that the apprehensions raised were not at a late stage, as the request for an independent assessment was consistently made and the ED rushed to court.

Further, the High Court declared that all facts had been duly considered by the senior district and session judge, and that the contested order did not suffer from any illegality or require any interference.

The court also observed that the DE’s apprehension cannot be characterized as flimsy or unreasonable and that such apprehension must be viewed from the perspective of a party and not from the perspective of a judge.
